Definition
Positions serve as a Reassumption Hearing Officer and are responsible for the timely issuance of a Corrective Notice of Redetermination (CNR), which affirms, modifies, or vacates any or all of the items cited on the original Citation & Notice (C&N). The RHO makes determinations to grant or deny stay of abatement date requests and documents the basis of that decision on the CNR and conference report.
Distinguishing Characteristics
Reassumption Hearings Officers act as the presiding officer at first level informal conferences with employers for the appeal of a Division of Occupational Safety and Health Citation and Notice on occupational safety and health cases. Positions have advanced knowledge of state and federal rules, regulations, policies, guidelines that pertain to compliance enforcement inspections and investigations.
Typical Work
Conducts informal conferences with employers for DOSH Appeals Unit to address occupational safety and health code violations which may result in changes to the violations in the Citation and Notice when replaced by the Corrective Notice of Redetermination created and issued by the RHO;
Issues CNR with associated penalties within specified timelines;
Conducts thorough reviews of employer appeal requests to fully understand information provided by the employer for use during the appeal;
Reviews inspection files and evaluates evidence presented and makes decisions on enforcement results modifications, vacates, or affirms the violations issued based on comparison to established policies;
Negotiates settlement agreements to include waivers of further appeal for penalty reductions, financial hardship settlement agreements, additional steps settlement agreements, or other types of settlement agreements;
Educates employers on how penalties are calculated and what actions can be taken to result in violations being vacated or modified and can result in penalty reductions, to help facilitate effective and efficient informal conferences;
Reviews employer requests for stays of abatement and makes a decision;
Produces appeal conference reports and issues CNR timely and accurately as required;
Obtains support from subject matter experts when needed (e.g., cranes, high-voltage, logging, etc.);
Schedules hearings in accordance with established timelines.

Knowledge and Abilities
Knowledge of: Report writing skills, use of computers and the internet to complete work product. Regulatory experience in applying occupational safety and health case law while reviewing inspections and investigations. Must have high level of knowledge regarding how CISHIs conduct inspections and document safety and health hazards, such as sampling and direct measuring techniques for chemical and physical hazards, noise and non-ionizing radiation; industrial processes and occupational hazards; chemical exposure assessment, and related exposure calculations. Knowledge of safety hazards such as falls from heights, trenches and excavation, and machine guarding. Knowledge of the different means to eliminate or control hazards identified during inspections/investigations. Extensive knowledge of many industries.
Ability to: Ability to follow DOSH regulatory and procedural policy manuals related to the DOSH Appeals process. Ability to learn, use and apply advance legal theory and occupational safety and health and employment case law in decision-making. Explain technical procedures, findings and penalty calculations in a language a layperson can understand. Effectively communicate with employers and their representatives throughout the appeal process to include writing write clear, concise reports. Ability to effectively manage a large number of cases simultaneously through a number of mandatory timelines.

Desirable Qualifications
Six years’ experience as a DOSH Compliance Industrial Safety and Health Investigator or equivalent experience as a Federal OSHA or other state plan journey-level safety and health specialist or industrial hygienist.
Must possess a valid and unrestricted driver license.
